Welcome to Growth Gremlins!

These Terms of Service (“Terms”) describe the rules and conditions under which you (“you,” “Customer,” or “User”) may access and use the hosting services, domain services, and related products provided by Growth Gremlins LLC (“Growth Gremlins,” “we,” “us,” or “our”).

By creating an account, purchasing a hosting plan, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.

We currently market and provide our Services only to customers in the United States. We may expand in the future, and if we do, we may update these Terms accordingly.



2. Scope of Our Services


2.1 Core Hosting Services

We provide managed WordPress hosting, including:

    • WordPress installed and configured on our hosting infrastructure.

    • Access to the full WordPress Content Management System (CMS).

    • Elementor Pro functionality for eligible templates (see Section 5).

    • Initial website setup and template installation (see Section 2.4).

Unless specified otherwise in your plan:

    • No staging sites are included by default.

    • No additional preinstalled plugins beyond WordPress core and any required components for our platform.

    • We do not provide email hosting; if we do in the future, updated terms will apply.

2.2 Hosting Infrastructure

Our hosting is powered by a third-party, white-label WordPress hosting provider. For performance and redundancy, servers may be located in multiple regions worldwide. By using our Services, you consent to your website and associated data being stored and processed on servers in the United States and in other countries, subject to applicable law.


2.3 Custom Plans

We offer custom hosting plans based on your specific resource and performance needs. These may include variations in:

    • Storage

    • Bandwidth

    • CPU/RAM allocations

    • Number of websites

Details of your specific plan (including limits) are provided during signup, checkout, or in your account dashboard.


2.4 Initial Setup & Template Installation

We provide:

    • Initial WordPress installation.

    • Installation and activation of one of our proprietary templates (if selected).

    • Basic configuration to match the chosen template.

We do not include ongoing content edits, design changes, or custom development within standard hosting. Any such work, if offered, is a separate, billable service under a separate agreement.


 

3. Accounts, Eligibility & Access

 

3.1 Accounts

    • Each website is tied to an individual user account.

    • You must keep your login credentials secure and confidential.

    • You are fully responsible for all activity occurring under your account.

If we believe your account has been compromised, we may temporarily suspend or limit access to protect you and our infrastructure.

 

3.2 Minimum Age & Capacity

    • You must be at least 13 years old to use our Services.

    • If you are under 18 (or under the age of majority in your state), you may only use the Services with the consent and under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

    • By using the Services, you represent and warrant that you are able to legally enter into a binding contract.

We do not knowingly provide Services to children under 13, and will terminate accounts that violate this requirement.


 

4. Your Use of the Services

You are responsible for:

    • All content on your website (text, images, video, code, etc.).

    • Ensuring your content and activities comply with:

        • These Terms and any policies we reference.

        • All applicable local, state, and federal laws and regulations.

We do not pre-screen all content and are not responsible for what you or your users publish or do on your site. However, we may review content or accounts if:

    • We receive a complaint (e.g., abuse report, DMCA notice).

    • We detect unusual or potentially harmful activity.

    • We suspect a violation of these Terms.

We reserve the right to request changes, remove content, suspend or terminate your account, or take other actions as described in these Terms.


5. Templates & Elementor Pro

 

5.1 Templates

We provide proprietary website templates and design systems that may be preloaded on your WordPress site as part of our Services.

    • You may use these templates only on websites hosted with Growth Gremlins.

    • You are not allowed to reuse, copy, export, or deploy our proprietary templates or template code on other hosting platforms or with other providers.

    • You own your original content (e.g., text, images, logos) placed into the templates (see Section 12), but the underlying template design, structure, and code remain our intellectual property.

5.2 Elementor Pro License

We hold and control the Elementor Pro license used on our hosting platform.

    • You are granted a limited, non-exclusive, non-transferable license to use Elementor Pro only on sites hosted with Growth Gremlins, for the duration of your active hosting plan.

    • You will not receive the Elementor Pro license key and must not attempt to extract, copy, or circumvent our license management system.

    • If you cancel or your hosting is terminated:

        • Your access to Elementor Pro features and updates through our license will cease.

        • You may continue using the free version of Elementor (subject to their terms), but you will no longer be entitled to use our Elementor Pro license.

        • Certain Pro functionality on your site may be downgraded or disabled unless you obtain your own Elementor Pro license.

We may change the page builder or tooling we provide in the future; if we do, we will update these Terms and notify you as appropriate.


 

6. Domains

 

6.1 Domain Registration & Transfer

We resell domain names through one or more third-party registrars. When you register, renew, or transfer a domain through us:

    • The domain is registered in your name (or your designated organization’s name) as the registrant.

    • You are also bound by the applicable registrar’s terms and conditions and ICANN policies (where applicable).

    • Those third-party terms are incorporated into these Terms by reference.

We do not charge our own additional fees for transferring a domain away from us, but the gaining registrar may have its own fees.

 

6.2 Domain Lifecycle

You are responsible for:

    • Keeping your domain registration information accurate and current.

    • Ensuring renewal happens before expiration.

If your domain expires:

    • You may lose the domain or incur additional fees (such as redemption fees) charged by the registrar.

    • We are not responsible if you lose a domain due to non-payment or failure to renew.

If your hosting with us ends but you wish to keep your domain:

    • You may transfer the domain to another registrar or DNS provider, subject to the registrar’s rules.

    • Our Elementor Pro license and templates do not transfer with the domain.


7. Fees, Billing & Refunds

 

7.1 Pricing & Plans

    • Hosting and domain pricing is shown at checkout, on our website, or in your account dashboard.

    • We reserve the right to change prices at any time for future billing periods.

    • If we change prices for an existing subscription, we will notify you in advance (e.g., by email) and the new price will apply on your next renewal.

7.2 Payment & Auto-Renewal

    • We use Stripe as our primary payment processor.

    • By providing your payment information, you authorize us and our payment processors to charge the applicable fees and store your payment details.

    • All hosting plans and relevant services renew automatically at the end of each billing cycle (e.g., monthly or annually), unless you cancel before renewal.

    • You can cancel renewal via your account or by contacting us; cancellation stops future billing but does not generate a refund for prior charges.

7.3 Grace Period & Non-Payment

If a renewal charge fails (e.g., card declined):

    • We may provide a 7-day grace period during which we may attempt to re-charge your payment method and your site may continue to operate.

    • After that, if payment is still not received:

        • We may suspend your site (making it inaccessible to visitors).

        • Continued non-payment may lead to termination of your account and deletion of data in accordance with Section 15.

7.4 No Refund Policy

To the fullest extent permitted by applicable law:

    • All fees are non-refundable, including:

        • Hosting fees.

        • Domain registration, renewal, or transfer fees.

        • Setup or onboarding fees (if any).

        • Any other recurring or one-time charges.

If a refund is required by law in your jurisdiction, we will comply with that legal requirement. Otherwise, all payments are final.


 

8. Acceptable Use & Prohibited Content

You agree not to use our Services for any unlawful, abusive, or inappropriate purposes. The following are prohibited (this list is illustrative, not exhaustive):

 

8.1 Prohibited Content

You may not host, upload, or transmit content that:

    • Is illegal or infringes any law (local, state, federal, or international).

    • Infringes intellectual property rights (copyright, trademark, etc.).

    • Involves child sexual exploitation or endangerment.

    • Promotes or depicts hate, harassment, or discrimination against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics.

    • Contains or promotes extreme violence, terrorism, or criminal activity.

    • Is pornographic or sexually explicit (including but not limited to commercial adult sites), if we determine it inappropriate for our platform.

    • Promotes self-harm, suicide, or the exploitation of vulnerable individuals.

    • Constitutes defamation, invasion of privacy, or violation of publicity rights.

    • Is misleading, fraudulent, or deceptive (e.g., scams, fake products/services, fraudulent investment schemes).

    • Violates any third-party platform’s policies in a way that could harm our relationships or infrastructure.

8.2 Prohibited Technical & Abuse Uses

You may not use our Services to:

    • Send spam, bulk unsolicited messages, or run mass email operations (including via scripts or plugins).

    • Host or distribute malware, viruses, trojans, ransomware, or similar harmful code.

    • Run crypto mining, proxies, VPN services, or similar high-risk or abusive services without our prior written consent.

    • Launch DDoS attacks, port scans, or other network attacks.

    • Overload or abuse server resources in a way that degrades service for others.

    • Host or support high-risk verticals we deem unacceptable (e.g., illegal gambling; certain high-risk financial schemes; other categories we may designate from time to time).

8.3 Enforcement & 3-Strikes Policy

We aim to enforce our Acceptable Use Policy fairly and reasonably:

    • Strike 1: Warning and request for correction or removal of offending content or behavior.

    • Strike 2: Temporary suspension or additional restrictions; final warning.

    • Strike 3: Termination of service for the affected website/account.

However, we reserve the right to bypass this 3-strikes process and take immediate action (including suspension or termination) if we believe:

    • The violation is severe (e.g., child exploitation, serious security risk, major illegal activity).

    • Our infrastructure, other customers, or the public are at immediate risk.

We strive to respond to abuse and DMCA-related reports within 3 business days.


 

9. Support & Maintenance

 

9.1 Support Channels

We provide customer support primarily via:

    • Phone: (949) 449-6283 (during published hours, if applicable)

We may update or expand support channels over time (e.g., ticketing systems, live chat).

 

9.2 Scope of Support

Our standard support covers:

    • Hosting platform issues (server errors, downtime, performance problems stemming from our infrastructure).

    • WordPress or plugin issues to the extent they are directly related to our platform configuration and standard stack.

Our standard support does not include:

    • Custom site design or development.

    • Content creation or editing.

    • Debugging issues caused by third-party plugins/themes you install.

    • Marketing, SEO, or strategic consulting.

We may offer such services separately for additional fees under separate terms.

 

9.3 WordPress & Plugin Updates

Growth Gremlins manages updates to:

    • WordPress core.

    • Elementor Pro and other standard plugins required by our environment.

We may:

    • Apply updates automatically.

    • Delay or test updates when necessary to protect stability and security.

We are not responsible for issues caused by plugins or themes you independently install that are not part of our standard stack.

 

9.4 Backups

We perform weekly backups of hosted sites, subject to reasonable technical limitations.

    • Backups are primarily for disaster recovery on our side.

    • We do not guarantee that backups will always be available or complete.

    • You are strongly encouraged to maintain your own independent backups of your site.

Upon request and subject to availability, we may assist with restoring a backup, but we do not guarantee restoration of any specific point in time.


 

10. Security

 

We take security seriously and provide a range of protections via our hosting provider and security tools, including (but not limited to):

    • Web Application Firewall (WAF): Managed WAF with blocklist/allowlist options and rules optimized for WordPress.

    • Malware Scanning: Scheduled scans and detection of suspicious files and vulnerabilities.

    • Automatic SSL: SSL certificates enabled by default for hosted sites.

    • Brute Force Protection: Server-level protection for common WordPress login endpoints.

    • Login Protection: Options for two-factor authentication (2FA), reCAPTCHA, strong password enforcement, and related measures.

These features may be delivered via third-party plugins and services and may evolve over time.

 

10.1 Your Security Responsibilities

You are responsible for:

    • Using strong, unique passwords and enabling 2FA where available.

    • Limiting access to admin accounts only to trusted individuals.

    • Keeping your own devices secure and free of malware.

    • Avoiding installation of low-quality or untrusted plugins and themes.

    • Immediately notifying us if you suspect a security issue or unauthorized access.

We cannot guarantee that security incidents will never occur, but we will use commercially reasonable efforts to mitigate and respond to them.

11. Privacy & Data Processing

We process certain personal data in connection with your use of our Services.

 

11.1 Data We Collect About You

We may process, among other things:

    • Account information: name, email address.

    • Billing information: payment details (processed via Stripe), billing address.

    • Technical data: IP address, log data, usage data, and other analytics and diagnostic information associated with your use of our Services.

We use Stripe for payment processing and WPMU DEV (or similar providers) for hosting infrastructure and security services. These third parties process data under their own privacy terms.

 

11.2 Role as Controller & Processor

    • For your account and billing relationship, Growth Gremlins is a data controller (we decide how and why this information is processed).

    • For data related to your website visitors (e.g., data stored in your WordPress database), we generally act as a data processor on your behalf, as the site owner, to the extent applicable law uses those concepts.

A separate, more detailed Privacy Policy will explain how we collect, use, share, and protect data. That Privacy Policy is incorporated into these Terms by reference.


 

12. Intellectual Property

 

 12.1 Our IP

As between you and us, Growth Gremlins (and/or our licensors) own all rights, title, and interest in and to:

    • Our hosting platform and infrastructure.

    • Our proprietary templates, designs, layouts, and code.

    • Our branding, trademarks, logos, and trade dress.

    • Any custom sections, designs, or development we create for you, unless otherwise agreed in writing.

We grant you a limited, revocable, non-exclusive, non-transferable license to use our platform and our templates only in connection with your active hosting account, subject to these Terms.

You must not:

    • Copy, resell, or redistribute our templates or platform.

    • Reverse engineer, decompile, or circumvent any technical protections.

    • Use our trademarks or branding without our prior written consent.

12.2 Your IP

You retain ownership of:

    • Your original content, including text, images, media, trademarks, and any other materials you upload or create on your website.

By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to:

    • Host, store, reproduce, and display your content as necessary to operate the Services.

    • Create backups and copies for security and operational purposes.

If we create custom work for you that uses both our IP and your IP, then (unless otherwise agreed in writing):

    • We own the underlying frameworks, structures, and reusable design elements.

    • You own your unique content included in those designs.

    • You receive a license to use the combined result on our platform for as long as you remain a paying customer.


13. Uptime, Maintenance & Service Changes

 

13.1 Uptime

We aim to provide 99.9% uptime on a monthly basis, measured across our infrastructure.

    • This is a target, not a guaranteed SLA with financial credits.

    • We do not provide monetary credits or refunds if uptime falls below this target.

    • Downtime may occur due to maintenance, network issues, security incidents, or other factors beyond our control.

13.2 Maintenance

    • We may perform maintenance, updates, or upgrades that temporarily affect availability.

    • Where reasonably possible, we will schedule such work at off-peak times.

    • In urgent or security-critical situations, we may perform maintenance without prior notice.

13.3 Changes to the Service

We reserve the right to:

    • Add, modify, or remove features or functionality.

    • Change the underlying hosting infrastructure or technology stack.

    • Replace third-party tools or integrations with alternatives.

We will make reasonable efforts to ensure changes do not materially degrade the core hosting service you receive. If we make major changes that significantly affect your use of the Services, we may notify you via email or via your account.


 

14. Termination & Data Export

 

14.1 Your Right to Cancel

You may cancel your hosting plan at any time by contacting us or using the available account tools. Cancellation:

    • Stops future billing after the current term ends.

    • Does not entitle you to a refund for prior charges (see Section 7.4).

14.2 Our Right to Suspend or Terminate

We may suspend or terminate your access to all or part of the Services:

    • For non-payment, after the 7-day grace period.

    • For material breach of these Terms or our Acceptable Use Policy.

    • If your site or account poses a security risk or materially impacts our infrastructure or other customers.

    • At our discretion, with at least 7 days’ notice, for any other legitimate business reason.

In severe cases (e.g., serious illegal activity, severe abuse), we may suspend or terminate immediately without prior notice.

 

14.3 Data Retention & Backups on Termination

Upon termination or cancellation:

    • We may retain your site data in backups for a limited period (e.g., up to 30 days) for operational or legal reasons, after which it may be permanently deleted.

    • You may request a backup (e.g., database export or files archive) during this retention window; we will make reasonable efforts to accommodate such requests, but cannot guarantee availability of any specific backup.

    • Your domain may be transferred to another provider (subject to registrar rules) if you request and complete the required steps.

Your right to use:

    • Our templates and platform IP ends upon termination.

    • Our Elementor Pro license ends upon termination; you must not continue using our license key or features powered by our license.


15. Disclaimers

To the fullest extent permitted by law:

    • The Services are provided on an “as is” and “as available” basis.

    • We do not warrant that the Services will be:

        • Error-free or uninterrupted.

        • Free of viruses or other harmful components.

        • Suitable for any particular purpose you may have.

You understand that:

    • Hosting websites inherently involves risks, including outages, security incidents, and data loss.

    • You use the Services at your own risk and are responsible for implementing appropriate safeguards (such as independent backups and security practices).

Nothing in these Terms is intended to exclude or limit any warranty or liability that cannot be excluded or limited under applicable law.


16. Limitation of Liability

To the fullest extent permitted by law:

    • In no event will Growth Gremlins, its owners, employees, contractors, or suppliers be liable for:

        • Any indirect, incidental, special, consequential, or punitive damages.

        • Loss of profits, revenue, data, goodwill, or business opportunities.

        • The cost of procuring substitute services.

    • Our total aggregate liability for any claims arising out of or relating to the Services or these Terms will not exceed:

        • The greater of (a) $50 or (b) the total fees you paid to Growth Gremlins for the Services during the twelve (12) months preceding the event giving rise to the claim.

These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, etc.), even if we have been advised of the possibility of such damages.


17. Indemnification

You agree to indemnify, defend, and hold harmless Growth Gremlins, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

    • Your use of the Services.

    • Your content and activities on or through your website.

    • Any breach of these Terms or violation of applicable law.

    • Any dispute between you and a third party, including your own customers or visitors.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.


 

18. Changes to These Terms

We may update or modify these Terms from time to time, for example to:

    • Reflect changes in our Services.

    • Comply with legal, regulatory, or security requirements.

    • Clarify language or improve structure.

When we change these Terms:

    • We will update the “Last updated” date at the top.

    • For material changes, we may also notify you by email or through your account dashboard.

By continuing to use the Services after the effective date of any changes, you agree to the updated Terms. If you do not agree, you must stop using the Services and cancel your account.


 

19. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or relating to them or the Services will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.

Any legal action or proceeding arising under or relating to these Terms will be brought exclusively in the state or federal courts located in California, USA, and you and Growth Gremlins consent to the personal jurisdiction and venue of such courts.

Nothing in this section limits any mandatory consumer protections that apply to you under the law of your state of residence.


 

20. Notices & Communications

We may provide notices to you via:

    • Email to the address associated with your account.

    • Notifications posted within your account dashboard or our website.

You agree that these electronic communications satisfy any legal requirement that communications be in writing.

21. Assignment & Miscellaneous

    • You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

    • We may assign or transfer our rights and obligations (for example, in connection with a sale of the business or reorganization) without your consent.

    • If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

    • Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

    • These Terms, together with any policies or documents referenced herein (including our Privacy Policy), constitute the entire agreement between you and Growth Gremlins regarding the Services.


22. Attribution

Portions of these Terms are adapted from Automattic Inc. ‘s Terms of Service, which are made available under a Creative Commons Attribution-ShareAlike license. We thank Automattic for making their legal documents available for adaptation.
